Federal Judge Orders Release of Abrego Garcia from ICE Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the judge noted that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Case
The court proceedings center on disputed assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Release
The judge, who was hearing his challenge to removal in a Maryland district court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This ruling marks a notable turn in a complicated immigration battle featuring claims of wrongful detention and disputed criminal affiliations.
